Application of section (s. 91(1)) — applies to any contract containing a condition providing for appraisal to determine matters in the event of disagreement between the insured and insurer
Two disinterested appraisers (s. 91(2)) — the insured and insurer each select a disinterested appraiser, then the two appraisers select a competent and disinterested umpire
Written finding of any two determines the matter (s. 91(3)) — if appraisers fail to agree, they submit differences to the umpire, and the finding in writing of any two determines the matters
Each party pays their own appraiser (s. 91(4)) — each party pays the appraiser selected by them and bears equally the expense of the appraisal and umpire
7-day deadline to appoint (s. 91(5)(a)) — a party must name an appraiser within seven clear days after being served with written notice
15-day deadline for umpire (s. 91(5)(b)) — appraisers must agree upon an umpire within fifteen days after their appointment
Court can intervene (s. 91(5)) — if a party fails to appoint or an appraiser/umpire refuses to act, a Supreme Court judge may appoint an appraiser or umpire
